General Terms and Conditions
These terms and conditions relate to trade relationships between a buyer and a seller, concluded in the internet shop www.colombiana.sk. The seller is Colombiana SK, s.r.o., Bartoškova 7, 831 04, Bratislava, IČO: 47 477 474, registered in the Trade Register Bratislava I, part: Sro, No.: 93451/B (hereinafter referred to as "Seller”).
The buyer is a physical or corporate entity that sent an electronic order through www.colombiana.sk. (hereinafter referred to as “Buyer”).
Order, contract concluding
Order means an electronic order form sent by the Buyer, which contains information about the Buyer, list of ordered goods and a total price of the order.
The electronic order is validated by completing all the data and appurtenances requested by the system in processing the order.
All received electronic orders are considered a draft of a purchase and sale contract.
The Seller will immediately send a confirmation of the received order to the Buyer’s email address, confirming the order number, goods specification, price of the goods and cost of delivery, and any other information. The order shall be processed as soon as possible after its acceptance. The Seller first verifies the availability of the ordered goods in stock, and then will send an email to the Buyer as a confirmation and concluding the further instruction depending on the chosen method of payment and delivery by the Buyer. By sending the confirmation email the purchase contract is considered as concluded.
Purchase price and payments
The prices of individual products stated on www.colombiana.sk are final and where applicable inclusive of VAT.
All sales are valid until the date stated in the product details, or until all the products are sold.
All other charges (packaging and postage fees) shall be charged separately according to the Buyer’s specification.

Delivery costs and other charges
The following charges are added to the individual price of goods depending on the method and address location of delivery:
Shipping in the Slovak Republic, up to 1000g:
bank transfer to the Seller’s account and delivery by Slovak Mail: 4 EUR
COD payment: 4 EUR
express courier by Slovak Mail : 8 EUR
collection in person in the Showroom coloMBiana: no fee
Shipping to the Czech Republic up to 1000g:
bank transfer to the Seller’s account and delivery by Slovak Mail: 5 EUR
delivery by express service by Slovak Mail : 15 EUR
Shipping to European Union up to 1000g:
bank transfer to the Seller’s account and delivery by Slovak Mail: 12 EUR
delivery by express service by Slovak Mail: 33 EUR
Shipping to the other countries up to 1000g:
bank transfer to the Seller’s account and delivery by Slovak Mail: 20 EUR
delivery by Express service by Slovak Mail: 35 EUR
Delivery of packages over 1000g will be charged according to the official tariff of Slovak Mail. In cases where the package is over 1000g, the Seller will contact the Buyer by email or by phone. After acceptance of the increased delivery price by the Buyer, the Seller will send a confirmation email to the Buyer.
Delivery terms and conditions
The delivery date depends on the availability of the products in stock of the Buyer and thus is stated individually for each product. Products drom the cathegory Jewellery from ouf web sitewe usually keep in stock and shall be shipped as soon as possible, usually within 3 working days, but not later than 14 days from sending the Order Confirmation. If the ordered goods are from the cathegory Clothes on our web site, it is considered as a custom made order according to the Buyer§s preferences and specification of the color, size and other agreed adjustments. These goods we do not keep in stock, but we will produce it just after receiving the Buyer§s order, usually by approximately 4 weeks. This period of time can be longer in the high season, mainly summer months.
If the goods are not in stock at the time of the order, the Buyer will not receive an email of Order Confirmation, but an email with the information about the possibility of product production and anticipated delivery date.
By sending an email Order Confirmation, the Seller confirms the availability of the ordered goods in stock. The goods shall be shipped as soon as possible, usually within 3 working days (if the goods are available), but not later than 14 days from sending the Order Confirmation. If the goods are not in stock at the time of the order, the Buyer will not receive an email of Order Confirmation, but an email with the information about the possibility of product production and anticipated delivery date.
The place and the delivery method of the goods shall be determined by the Buyer when producing the online order. An order is considered to be finished when the goods are accepted by the Buyer. The Seller cooperates with Slovak Mail in terms of delivery; therefore 1-3 days shall be added to the delivery date. The Seller is not responsible for delayed delivery and damages caused by the postal service. If the Buyer’s selected method of delivery is collection in person in the Showroom coloMBiana, then by producing the online order, goods can be accepted directly in the showroom coloMBiana by the Buyer without additional charges to the price of the ordered goods.
The Buyer will be informed by email about the shipping of the ordered goods by Slovak Mail. If the goods are not delivered to the Buyer within 7 days from receiving the information email, he/she shall contact the Seller. The Seller will verify the status of the shipped goods with the postal service and immediately inform the Buyer.
The Buyer is obliged to accept the goods properly and on time at the place specified in the order. If the buyer fails to accept the goods from a courier or the delivery is to be repeated because of the absence of the Buyer, all costs connected with it shall be reimbursed by the Buyer.
When accepting the goods, the Buyer is obliged to check the delivery and to inform the Seller about any damage to packaging or the goods immediately (not later than within 3 days). If the consignment is visibly damaged or destroyed, the Buyer is obliged to contact the Seller without accepting the consignment. If the goods delivered do not match with the order, the Buyer is obliged to inform the Seller about this fact in writing without any delay. Any subsequent complaints relating to the order including the physical damage to the goods shall be refused.
Warranty and complaints
The Seller shall provide for all the goods a warranty of 24 months from acceptance of the goods by the Buyer. The consignment of goods always includes an invoice which acts as the warranty certificate.
The warranty does not cover defects caused by the product use at variance with its purpose or mechanical damage like broken parts, scratches or abrasions. A complaint shall not be accepted in cases of not following the instruction of use, damage of parts by water, perfume or human perspiration.
When making a complaint, it is recommended to contact the Seller by phone or e-mail before making a complaint to inform them about the product defect. As a result, the seller will recommend further procedures. Goods which are subject of the complaint shall be re-delivered to the address of the Seller: Colombiana SK, s.r.o., Bartoškova 7, 83104, Bratislava (recommended to do so after previous agreement with the Seller).
No cash on delivery sent to the Seller will be accepted.
Goods, which are subject of complaint can be delivered in person to the coloMBiana showroom.
The Seller shall repair defects without delay, at the latest within 30 days from claim acceptance. In the event that the defects cannot be eliminated, the Seller is obliged to replace faulty goods for new ones or shall offer other goods in the value of the original order. The Seller is entitled to cancel the contract issuing a credit note in the amount of the original goods price.
The Buyer will be informed about the result of the complaint by email immediately, after completion of the complaints process.
Avoidance of contract Cancelling Contract & Returning Goods
The Buyer is entitled to cancel a contract and return the goods without giving any reason within 14 days from the day of the goods acceptance. The Buyer can cancel the contract in writing, by e-mail. The order number and the date of purchase must be included. However, it is essential that the Buyer returns the goods: complete and unused in the original packaging together with the purchase receipt. The return of goods are at the Buyer’s expense. No cash on delivery is accepted when returning the goods. When all of the above conditions are satisfied the Seller is obliged to send back the money for the goods to the Buyer’s account within 14 days from the acceptance of the returned goods.
The Seller reserves the right to cancel an order when the required goods are not available in stock for a longer period. The Seller will inform the Buyer about it immediately.
ColoMBiana, s.r.o. appreciates their customers, bears in mind that internet shopping requires a large amount of trust and will respect the privacy of the customers. All information that the Buyer submits will be used only for the purpose of communication with customers and for the delivery of the ordered goods. The Seller will not share personal information without the permission of the customer to third parties in accordance with the Data Protection Act, No. 122/2013.

The condition of electronic order validation is the completion of the following data and appurtenances requested by the system in processing the order:
Name and Surname
By sending an order, the Buyer approves the Seller to process and use the submitted personal data in accordance to the Data Protection Act, No. 122/2013 and its successive amendments. Providing the personal data via the website of the Seller is done on an entirely voluntary basis. The Buyer has the right to request in writting to delete personal data stored about him/her. In such a case, the Seller will notify the Buyer within one month of receiving the request how he would comply with the request and the personal data shall be deleted.
The personal data is stored in a protected database on a server of the Buyer. The data is processed for the purpose of dealing with orders, delivery of the goods, accounting system and invoicing.
Personal data of the customers shall be treated with confidentiality. The data will not be disclosed to third parties or any other subjects, with the exception to organisations where cooperation is necessary for proper processing of the order, such as banks and postal service provider.
The Seller has the right to process personal data even after the conclusion of the original purpose for statistics/ accounting purposes, and to submit to third parties summary information only, without identification of the individual customer.
The Seller reserves the right to change, cancel or adapt the Business Terms and Conditions or a part of them, without further notice, whereby the order terms and conditions will be subject to Business Terms and Conditions valid on the day of sending the order by the Buyer.
These Business terms and Conditions are valid with effect from 1.1. 2015.
